Terms of Service

The service

Smara is an application for macOS, iOS and Android that builds a private knowledge graph from accounts and data sources you choose to connect, on the device you are using, and answers questions about them using AI running on Smara's servers ("Smara Cloud"). An active subscription is required to answer questions; without one, Smara can still sync your accounts and show your lists. How your data is handled is described in our Privacy Policy, which is part of these terms.

Smara is sold two ways:

• Smara — $9.99 a month after a 14-day free trial, covering up to 3 devices; see Your subscription below.
• Enterprise — available by contacting sales, and governed by your organization's agreement with us, which takes precedence wherever it differs from these terms.

Smara for Mac is a notarized app downloaded from downloads.usesmara.ai, and is not available on the Mac App Store. Where Smara is offered for iPhone or Android, it is installed from Apple's App Store or Google Play and is covered by the same subscription and these same terms. Your subscription is a license key you activate inside the app; there is no Smara account to create.

License

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Smara on devices you own or control (or, for enterprise deployments, on devices your organization manages), up to the device limit of your subscription, for your internal business or personal productivity use. Smara for Mac requires a Mac with Apple Silicon and macOS 15.1 or later; Intel Macs are not supported. Seat counts, fees, and deployment terms for organizations are set in the applicable Enterprise agreement.

You may not:

• copy (except for reasonable backup), modify, or create derivative works of the app;
• reverse engineer, decompile, or disassemble the app, except to the extent applicable law permits it despite this restriction;
• sell, rent, lease, sublicense, or redistribute the app;
• remove or alter any proprietary notices in the app.

Your subscription

• Sold by Lemon Squeezy. A Smara subscription is sold by Lemon Squeezy as merchant of record, so your purchase is also subject to Lemon Squeezy's buyer terms. Lemon Squeezy handles payment, tax and invoices.
• Free trial. A subscription starts with a 14-day free trial, limited to one per customer. You need to enter a payment card at checkout. Unless you cancel before the trial ends, your paid subscription starts when it ends and your card is charged $9.99 a month from then on. If you cancel during the trial from the billing portal at usesmara.ai/account, you won't be charged.
• Renewal and cancellation. Your subscription renews every month until you cancel. You can cancel at any time from the billing portal at usesmara.ai/account. Cancelling takes effect at the end of the period you have paid for, and Smara keeps answering until then. After that, Smara can still sync your accounts and show your lists on each device, but cannot answer questions until you subscribe again.
• Refunds. We don't give refunds for partial billing periods, except where the law requires one — for example, withdrawal rights for consumers in the EU or UK.
• Price changes. We will announce any price change at least 30 days before it takes effect, and the new price applies from your next renewal after that.
• Fair use. Your subscription includes a fair-use allowance of about 30 million tokens a month, counted per subscription and shared across all of its devices, and it resets monthly. If you use up the allowance, Smara keeps syncing your accounts and showing your lists, but summaries and answers pause until the allowance resets.
• Up to 3 devices. One subscription covers up to 3 devices. You may not share your license key beyond that. You can free a slot by deactivating a device in the app.
• Changes and availability. The model behind Smara Cloud, and Smara's features, may change over time, and some features are available only on some platforms. Smara Cloud is provided on a best-effort basis, with no uptime guarantee. If it is unavailable, Smara cannot answer questions until service is restored; syncing and your lists keep working, and we do not credit or refund for interruptions except where the law requires it.

Acceptable use

You may not:

• circumvent Smara's usage limits or device limits;
• abuse or reverse-engineer Smara's servers;
• resell your subscription.

We may suspend or end your subscription if you break these rules.

Updates

Smara can update itself automatically, and you can turn automatic update checks off in the app. What an update check sends is described in the Privacy Policy. We update Smara regularly, and features may change, be added, or be removed.

Your data and your responsibilities

• Your data stays yours. You retain all rights to the content Smara indexes on your device, and we claim no ownership of it. Your index stays on your own device and we never receive it. The text behind each request passes through Smara Cloud to Cloudflare Workers AI only to produce your answer, is not stored, and is never used to train any model.
• Connect only what you're allowed to. You are responsible for ensuring you have the right to connect the accounts and data sources you connect, including under your employer's policies.
• Third-party terms apply. Connecting Google or Microsoft accounts is subject to those providers' own terms of service, and Smara's access is governed by the permissions you grant them.
• Lawful use only. You may not use Smara to violate any law or third-party right.

AI output

Smara's summaries, rankings, and answers are generated by AI from your own data, by a model running in Smara Cloud. Like all AI output, they can be incomplete or inaccurate. They are provided as a productivity aid, not professional advice — verify anything important against the underlying source, which Smara links wherever possible.

Replies Smara drafts are sent only when you click Send; review them first. You are responsible for messages you send.

Intellectual property

The Smara application, this website, and the Smara name and brand are owned by Smara and protected by intellectual-property law. Except for the license above, these terms grant you no rights in them. Where a Smara build downloads an AI model to run on your own device, that model is licensed under its own upstream terms.

Disclaimer of warranties

Smara is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its output will be accurate.

Limitation of liability

To the maximum extent permitted by law, Smara will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising out of or related to your use of the app or website. Our total aggregate liability will not exceed the amount you paid for Smara in the twelve months before the claim (or US $50 if you paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may stop using Smara at any time; deleting the app and its data is described in the Privacy Policy. We may suspend or terminate your license if you materially breach these terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) survive.

Changes to these terms

We may update these terms as the product evolves. Changes take effect when posted on this page with a revised effective date; material changes will be called out in the app's release notes. Continuing to use Smara after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. For users covered by an Enterprise agreement, the governing law and venue in that agreement control.
